Appeals and Special Litigation
The Appeals & Special Litigation Division is comprised of several bureaus handling discovery, motion practice, post-conviction litigation, appeals, and training newly hired Assistant District Attorneys (ADAs). Division members also manage Freedom of Information Law (FOIL) requests, coordinate Continuing Legal Education (CLE) lectures, and provide Legal Updates lectures for law enforcement personnel.
The Appeals Bureau litigates all appeals from judgements of conviction before the Appellate Division and Appellate Term, the intermediate appellate courts, and the New York Court of Appeals, that state’s highest court. The Bureau also manages all appellate motion practice, including applications for bail pending appeal and writs of error coram nobis. In addition, the Bureau provides legal guidance to other Division on issues arising in pending investigations and prosecutions.
Established in 2021, the Discovery Bureau oversees the office’s discovery obligations, including the cataloging and distribution of documents, body-worn camera footage, and other materials required to be disclosed under the Criminal Procedure Law. The Bureau also provides training and guidance on discovery-related matters to office personnel and outside law enforcement agencies. Its team consists of experienced Assistant District Attorneys and paralegals.
Newly hired prosecutors begin their careers at our office in the Motions and Training Bureau, reinstated by District Attorney Cacace in 2025. Working alongside experienced trial attorneys, they draft pretrial motions in felony cases, review case files and digital evidence, and conduct legal research on key issues such as Fourth Amendment search and seizure – all while conferring with the experienced trial prosecutor assigned to the matter.
Prosecutors also complete an approximately three-month training program featuring lectures on legal practice, ethics, and criminal prosecutions, along with mock trial exercises that include jury selection, opening statements, witness examinations, and summations. The program includes mentorship from experienced attorneys, tours of the Westchester County Department of Laboratories and Research and County Jail, and visits to local branch offices. Upon completion, prosecutors transition to the Local Criminal Courts and Grand Jury Division.
The General & Post-Conviction Litigation Bureau responds to all collateral post-conviction motions challenging the legality of convictions or sentences, federal habeas corpus petitions, extradition matters, Freedom of Information Law (FOIL) requests, and related special proceedings and appeals. The Bureau also handles applications for resentencing under the Domestic Violence Survivors Justice Act (DVJSA), as well as miscellaneous motions in superior court.
The Freedom of Information Law (FOIL) pertains to the public's right to request government records. All requests made to the Westchester County District Attorney’s Office pursuant to FOIL must be submitted in writing to the Records Access Officer. Submit a FOIL request.
