Defendant: Anthony Burton aka David Burton aka Faseoff (DOB 09/05/1981)

Sept. 30, 2019 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced defendant Anthony Burton of Pensacola, Florida, formerly of Yonkers, was found guilty on all counts following a bench trial before Westchester County Court Judge Anne Minihan. Burton was tried for the murder of a Yonkers man in April 2016. For a time, he was a fugitive from justice, and was subsequently returned to New York to face the charges.

  • Murder in the Second Degree, a class A violent felony
  • Two counts of Criminal Possession of a Weapon in the Second Degree, class C violent felonies

Sentencing is scheduled for Nov. 12, 2019.

Background
Just after midnight April 30, 2016, outside 111 Waverly St., Yonkers, Burton pulled out a handgun and fired three shots at the victim, striking him in the abdomen, back and hip. The victim was found semiconscious in the street by responding Yonkers Police Officers and was transported to Jacobi Hospital in the Bronx by EMS. The victim remained hospitalized until June 2, 2016, when he died from his injuries.

A Westchester Grand Jury indicted Burton last year and Yonkers Police began to search for him. Burton was discovered at the Queen Mary Inn in Pensacola, Florida, where he was arrested on local charges, including contributing to the delinquency of a minor, resisting arrest, false personation and possession of a controlled substance. Following the investigation by Yonkers Police, the Westchester County Police Warrant Squad picked up Burton in Florida and returned him to Westchester Nov. 28, 2018.

He was extradited to New York Nov. 28, 2018.

Assistant District Attorneys Brian Bendish of the Superior Court Trial Division, and Lana Hochheiser, Deputy Chief of the Homicide Bureau, prosecuted the case.
