Defendant: Garth Trail (DOB 09/04/56)

Sept. 11, 2019 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced that defendant Garth Trail, who pleaded guilty in November 2018 to engaging in a sexual act with an inmate victim while working at the Taconic Correctional Facility, was sentenced Tuesday and remanded into custody.

Trail was a former head cook employed by NYS Department of Corrections and Community Supervision (DOCCS) at the Taconic Correctional Facility in Bedford Hills, a medium security correctional facility in Bedford Hills that houses women only. He resigned his job Sept. 30, 2017.

Specifically, Trail pleaded guilty in Nov. 2018 to a count of Criminal Sexual Act in the Third Degree, a class E felony.

Trail was sentenced to “shock probation” where he will serve four months in jail followed by the remaining 10 years’ probation. He will register as a sex offender.

Background
On May 1, 2018, New York State Police arrested Trail for engaging in a sexual act with an inmate victim on Sept. 27, 2017, in the kitchen area of the facility. His arrest was the result of an investigation by the Westchester County District Attorney’s Office, DOCCS and the New York State Police.

Assistant District Attorneys Laura Murphy, Chief of the Career Criminal Bureau, and Jennifer Sculco of the Public Integrity Unit, prosecuted the case.
