Defendants: Feliciano Perez Bautista (DOB 03/07/88); Jorge Arce Villano (DOB 10/16/93)

Oct. 29, 2019 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced that Feliciano Perez Bautista and Jorge Arce Villano, both of Yonkers, have been indicted by a Westchester County Grand Jury in the death of
Efigenio Jose Rojas in July.

They were arraigned today in Westchester County Court before Judge Susan Cacace. The two men are expected back in court Nov. 12, 2019.

Villano and an unnamed third defendant, still at large, are charged with Manslaughter in the First Degree, a class B violent felony, and Gang Assault in the First Degree, a class B felony. Bautista is charged with Gang Assault in the Second Degree, a class C felony.

Background
On July 8, 2019, around 2 a.m., prosecutors allege, Feliciano Perez Bautista, Jorge Arce Villano and an unnamed third defendant encountered the victim, Efigenio Jose Rojas, in a New Main Street eatery. Words were exchanged between the unnamed defendant and Rojas. The exchange erupted into violence which spilled into the street. Outside, the fight escalated to the point where the three co-defendants joined in beating Rojas to unconsciousness. When the three men fled the area a Good Samaritan obtained aide for Rojas. He was taken to the hospital with serious injuries and died days later.

Assistant District Attorney Michelle Lopez, Chief of the Sex Crimes Bureau, is prosecuting the case.
