Defendant: James McNair (DOB 08/01/94)

Oct. 15, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced James McNair of Yonkers was sentenced Friday on two counts of Attempted Murder in the Second Degree, class B violent felonies, after two shooting incidents in January of this year targeting the same man.

McNair appeared before Judge Larry Schwartz. For each count, he was sentenced to 10 years in state prison. Both sentences to run concurrently (at the same time). McNair pleaded guilty to both counts July 24, 2018.

Background
In the first incident Jan. 14, 2018, in front of a delicatessen located at 373 Warburton Ave. in Yonkers, McNair aimed a loaded firearm at his intended victim and fired three times at close range but no one was hit by the bullets. The incident was captured on video surveillance.

In the second incident, Jan. 20, 2018, in an apartment building located at 296 Woodworth Avenue, McNair opened fire on the same victim, this time striking him with a bullet that caused serious injury to the victim’s leg and back. Portions of this incident were captured by video surveillance. The victim was hospitalized for an extended period of time, but never cooperated with the police or prosecutors. Yonkers Police arrested McNair Jan. 23, 2018.

The case was prosecuted by the Investigations Division Gang, Firearms and Narcotics Bureau.
