Defendant: Garth Trail (DOB 09/04/56)

Nov. 13, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Garth Trail, a former head cook at the Taconic Correctional Facility in Bedford Hills, employed by NYS Department of Corrections and Community Supervision (DOCCS), pleaded guilty to Criminal Sexual Act in the Third Degree, a class E felony. Westchester County Court Judge Susan Cacace accepted the plea. Trail is scheduled back in court for sentencing Feb. 26, 2019. Currently, he is free on bail. Trail resigned Sept. 30, 2017.

Background
On May 1, 2018, New York State Police arrested Trail for engaging in a sexual act with an inmate victim on Sept. 27, 2017, in the kitchen area of the facility. Following the arrest, which was the result of a joint investigation between the Westchester County District Attorney’s Office, DOCCS and the New York State Police, Trail was arraigned in the Town of Bedford and released on his own recognizance. Taconic Correctional Facility is a medium security correctional facility in Bedford Hills that houses women only.

Assistant District Attorneys Laura Murphy, Chief of the Career Criminal Bureau, and Jennifer Sculco of the Public Integrity Unit are prosecuting the case.

Note: Trail’s arrest with two other employees was the subject of a news conference May 4, 2018, at the District Attorney’s Office. He is the third and final defendant in this case to plead guilty.
