Defendant: Michael Gagliardi (DOB 01/01/68)
 
July 23, 2020 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Michael Gagliardi of Somers was sentenced in Westchester County Court on child pornography charges. He appeared in person before Judge Susan Cacace.
 
Specifically, Gagliardi was sentenced to 10 years sex offender probation on each of these charges:

  • Promoting an Obscene Sexual Performance by a Child, a class D Felony
  • Possessing an Obscene Sexual Performance by a Child, a class E felony

The sentences will run concurrently. He will have to register as a sex offender under New York’s Sex Offender Registration Act (SORA).
 
Background
In July 2019, the District Attorney’s Office received notification from another law enforcement agency that a resident at a Somers address downloaded pornographic images of children. Michael Gagliardi lived at the address.
 
Following search warrants served by the District Attorney’s Criminal Investigators, explicit images of a female child victim approximately four to six years old were found downloaded on Gagliardi’s home computer. The download was completed Feb. 27, 2019.
 
DA’s Criminal Investigators squad, with assistance from New York State Police Troop K Somers barracks, made the subsequent arrest. The case was prosecuted by the Investigations Division Cybercrime Bureau.
