WHITE PLAINS, N.Y. – Westchester County District Attorney Susan Cacace announced today that Bryan Martinez, 31, of Port Chester, was sentenced to 10 years in state prison for attempting to murder an off-duty New York City Police Department officer in November 2023.
Mr. Martinez was sentenced yesterday by Westchester County Court Judge George Fufidio, Jr., who additionally ordered him to undergo 5 years of post-release supervision and provided an order of protection for the Victim.
DA Cacace said: “An attempted murder, committed in broad daylight, nearly claimed the life of an NYPD officer. This brazen violence also endangered the lives of one or more passersby, who had no involvement in this dispute. My office will always take swift action to protect the public against this kind of violent conduct. I am thankful that the officer survived this assault and has largely recovered from his physical injuries.”
On Nov. 14, 2023, Mr. Martinez began to stalk and follow the Victim’s car over a personal grievance. At a traffic light in Yonkers, Mr. Martinez shot his 9 mm pistol past another car that was situated between himself and the Victim. One of these bullets struck the Victim in the arm.
The Victim then drove himself to St. John’s Hospital in Yonkers, where he was treated for his injuries.
In September, Mr. Martinez pleaded guilty to attempted Murder in the Second Degree.
The investigation was conducted by the Yonkers Police Department, the Westchester County Department of Public Safety, the Westchester County Real-Time Crime Center, the Port Chester Police Department, and the Federal Bureau of Investigation’s Safe Streets Task Force.
The case was prosecuted by Nadine Nagler, Chief of the Trial Division, and Senior Trial Counsel Brian Bendish of the Homicide Bureau
