Feb. 26, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Jerry Colon (DOB 01/24/80) of Yonkers was convicted on Friday, Feb. 23, 2018, of two felony counts stemming from a car break-in on South Broadway in Yonkers last December.

Colon was convicted after a jury trial in front of County Court Judge George Fufidio on one count of Robbery in the 1st Degree, a class B violent felony; one count of Criminal Possession of a Weapon in the 3rd Degree, a class D felony; one count of Criminal Possession of Stolen Property in the 5th Degree and Criminal Mischief in the 4th Degree, both misdemeanors.

Background
The charges stem from an incident on Dec. 14, 2016. At approximately 2 a.m., the defendant. Jerry Colon, broke into the victim's vehicle in a parking lot at 260 South Broadway in Yonkers. The victim, who was walking to his vehicle at the time, saw the defendant still in his Chevy Suburban. He attempted to stop Colon and get him to return an IPad and GPS device which the defendant had stolen from inside the SUV. The defendant then pulled out a box cutter which he swung at the victim in order to retain the stolen goods. Despite the Colon’s use of a box cutter, which he swung at the victim at least twice, the victim was able to overcome him and hold Colon until the police arrived at scene. Yonkers Police responded to the incident and recovered the box cutter used by the defendant as well as the stolen electronics. The defendant's DNA was further found on the box cutter which police recovered.

Colon is currently scheduled to be sentenced on March 27, 2018. He faces a maximum sentence of 25 years in state prison on the top charge of Robbery in the First Degree.

The case is being prosecuted by Assistant District Attorney James Bavero.
