Feb. 14, 2013 -- Westchester County District Attorney Janet DiFiore announced that Mario Garcia-Sura (DOB 07/20/64) of 77 Locust Hill Avenue, Yonkers, New York was arraigned today on a nine-count indictment charging him with:

  • one count of Aggravated Vehicular Homicide, a class “B” Felony,
  • two counts of Vehicular Manslaughter in the Second Degree, class “D” Felonies,
  • one count of Criminally Negligent Homicide, a class “E” Felony,
  • two counts of Driving While Intoxicated, Unclassified Misdemeanors under the New York State Vehicle and Traffic Law,
  • one count of Reckless Driving, an Unclassified Misdemeanor under the New York State Vehicle and Traffic Law,
  • two counts of VTL 1180, Speed in Excess of 55 Miles per Hour, a Traffic Infraction under the NYS Vehicle and Traffic Law.

On Oct. 20, 2013, the defendant was operating his 2001 black Ford Mustang convertible along Riverdale Avenue in Yonkers. He had a front seat passenger with him.

The two men had met earlier in the day in a local deli and during the course of the afternoon began to drink together and drove around in the defendant’s Mustang visiting neighborhood bodegas drinking beers.

At about 5:13 p.m., Garcia-Sura drove his Mustang down Riverdale Avenue at a high rate of speed and at the intersection of Riverdale Avenue and Franklin Avenue collided with a 2004 gold Hyundai Sonata operated by the 19-year-old victim Sreeraj Chandran.

The victim was taken to St. Joseph’s Hospital where he was pronounced dead at approximately 6:12 p.m.

The defendant’s passenger was taken to Jacobi Medical Center where he was admitted for severe injuries to his lower body.

Bail was set at $250,000 cash or bond.

His next court appearance will be on Feb. 25, 2014.

He faces a maximum sentence of twenty five years in state prison.

Assistant District Attorney Kristina Dushaj, of the Superior Court Trail Division, is prosecuting the case.
