Statement from Westchester County District Attorney Miriam E. Rocah

“On the one-year anniversary of the tragic death of Yonkers Police Detective Sgt. Frank Gualdino—a beloved father, husband, son, brother and life-long public servant—we thank Detective Sgt. Gualdino’s family, with whom we have been in close contact, and acknowledge their incredible patience during our year-long investigation with the Yonkers Police Department.

“We left no stone unturned in our criminal investigation and secured the October grand jury indictment of the 16-year-old defendant for Criminally Negligent Homicide in the December 2022 vehicular crash that killed Detective Sgt. Gualdino.

“The grand jury’s return of the indictment in this case was one step in a process we undertook to ensure accountability for the death of Detective Sgt. Gualdino. However, due to the defendant's age (16), under 2019’s Raise the Age law and its legal requirements, the case was transferred to Family Court and the records of the criminal proceedings in the Youth Part were sealed. Going forward, the Family Court proceedings will be handled by the Office of the Westchester County Attorney, as the District Attorney’s Office no longer has jurisdiction

“We understand the deep disappointment and frustration of Detective Sgt. Gualdino’s family, friends and the community that there will not be a public proceeding in criminal court. Our office continues to mourn the profound loss of Detective Sgt. Gualdino and we will continue to support his family however we can.”
