New Rochelle Man Sentenced to 13 Years for Sexually Assaulting Teenage Boys

WHITE PLAINS, N.Y. – Westchester County District Attorney Susan Cacace announced that a New Rochelle man was sentenced Tuesday to 13 years in state prison for sexually assaulting three teenage boys.

Fernando Rincon, 53, of New Rochelle, had pleaded guilty in March to one count of Criminal Sexual Act in the Second Degree, a class D felony, and two counts of Criminal Sexual Act in the Third Degree, a class E felony.

Judge Robert Prisco, who handed down the sentence, further sentenced Rincon to 10 years of post-release supervision and issued permanent orders of protection on behalf of the victims. Rincon will also be required to register as a sex offender.

DA Cacace said: “The defendant preyed upon a vulnerable population in order to commit these sickening acts. The trauma these victims suffered through can never be undone. But owing to their courage, we have now been able to obtain a substantial penalty that will remove the defendant from liberty for over a decade.”

Between January and April of last year, Rincon sexually assaulted three boys between the ages of 14 and 15, committing the crime of Criminal Sexual Act. In late 2024, state legislators repealed Criminal Sexual Act and reclassified this conduct as rape, though it was not retroactive.

Rincon was further accused of filming the victims during these encounters.

The case was investigated by the New Rochelle Police Department.

The case was prosecuted by Senior Assistant District Attorneys Charlotte Gudis and Stephanie Baehr, both of the Child and Elder Abuse Bureau.
