April 20, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Roshan Samuel (DOB 03/18/82) of 17 Dunnings Dr., Tarrytown, NY was sentenced today to five months shock probation followed by four years probation after having been convicted by a jury on March 14, 2016 of:

  • two counts of Disseminating Indecent Material to Minors in the First Degree, class “D” Felonies.

On or about and between Oct. 21, 2014 and Oct. 23, 2014, at various times, at 98 South Goodwin Ave., Village of Elmsford, NY, the defendant engaged in conversations of a sexual nature with a fourteen-year-old girl at Alexander Hamilton High School. The defendant believed she was sixteen years old. The conversations were in the form of text messages and voice calls through the Tango social media application.

On or about Oct. 21, 2014, the defendant sent text messages to the child describing sexual acts and inviting her to engage in sexual activity with the defendant.

At approximately 2:30 p.m. the defendant went to the parking lot of Alexander Hamilton High School where the child was observed on video entering and exiting a motor vehicle driven by the defendant. At that time, there was no physical contact between the two.

On or about and between Oct. 22, 2014 and Oct. 23, 2014, the defendant sent photographs of himself including two photographs of his genitals with explicit messages to the child indicating that he wanted to have sex with her.

School officials were notified by the victim’s mother about the social media contacts between the defendant and her daughter. Police were then notified. School officials were able to provide police with surveillance video of the parking lot encounter as well as screen shots from the cellphone used by the victim.

After an extensive investigation, the defendant was arrested on Oct. 30, 2014 at the Village of Elmsford Police Department at approximately 1 p.m.

The defendant was remanded to the Westchester County Jail in Valhalla to serve the five months of shock probation.

Upon his release, he will have to serve out his four-year probation under sex offender conditions to include having his name placed on the sex offender registry.

Assistant District Attorney Pauline Haynes and Assistant District Attorney Toni Ann Gagliardi of the Special Prosecutions Division prosecuted the case.
