WHITE PLAINS, N.Y. – Westchester County District Attorney Miriam E. Rocah announced today that a 16-year-old Yonkers resident was arraigned on an indictment charging him with Criminally Negligent Homicide for the December 2022 vehicular crash in Yonkers that resulted in the death of 53-year-old Yonkers Police Detective Sgt. Frank Gualdino.

DA Rocah said: “My Office has been committed throughout this nearly year-long investigation to seeking accountability in this tragic and devastating incident that took the life of Detective Sgt. Gualdino.”

A Westchester County Grand Jury indicted the defendant as an adolescent offender for Criminally Negligent Homicide, a felony. The defendant was arraigned today before Westchester County Court Judge Helen Blackwood in the Youth Part, where bail was set at $5,000 cash/$10,000 bond/$25,000 (10% partially-secured bond). The defendant’s next court date will be Dec. 15.

On Dec. 1, 2022, at approximately 3:35 p.m., the defendant, allegedly drove a BMW M5 Competition in a criminally negligent manner on Tuckahoe Road in Yonkers, resulting in the vehicle crossing the double yellow line into oncoming traffic and into the victim’s unmarked police car.

The victim was transported to Jacobi Medical Center in the Bronx, where he was pronounced dead.

The Yonkers Police Department arrested the defendant on Oct. 30 following his surrender.

The investigation was conducted by the Yonkers Police Department, Westchester County Department of Public Safety and the Westchester County District Attorney’s Office.

The case is being prosecuted by Major Case Bureau Chief Nadine Nagler and Assistant District Attorney Michael Callan.

The charges against the defendant are merely accusations, and the defendant is presumed innocent unless and until proven guilty.
