Nov. 29, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Janiel Myke (DOB 09/09/91) of 140 Rolling Valley Way, Peekskill, NY was sentenced today to fifteen years in state prison after having pled guilty to:

  • one count of Manslaughter in the First Degree, a class “B” Violent Felony

in the shooting death of Stephen Agosto.

On Dec. 20, 2015 at approximately 10:20 p.m., the defendant shot the victim three times with a stolen 9mm handgun in front of 1431 Park St. in Peekskill. The victim was taken to a local area hospital where he was later pronounced dead.

An intensive investigation by the Peekskill Police resulted in the defendant’s arrest on Dec. 22, 2015. It was determined that both the victim and Myke had a long standing dispute.

An autopsy conducted by the Medical Examiner’s Office revealed that the victim suffered a fatal bullet wound to the head and a bullet wound to each of his legs.

The defendant was remanded to the custody of the New York State Department of Corrections.

Assistant District Attorney Heide Mason of the Superior Court Trial Division prosecuted the case.
