Defendant: Smile Nicasio-Ramirez (DOB 01/23/95)

May 23, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. today announced Smile Nicasio-Ramirez of Queens pleaded guilty in the stabbing death of a co-worker at a restaurant on McLean Avenue, Yonkers, in October 2017.

Nicasio-Ramirez was charged with Manslaughter in the First Degree, a B violent felony, and Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor. He pleaded guilty on both counts before Westchester County Court Judge Barry Warhit.

Background
The defendant and the victim were both working at a Spanish restaurant at 640 McLean Avenue, Yonkers on October 17, 2017, when an argument broke out between them around 4:50 p.m. Nicasio-Ramirez grabbed a kitchen knife and stabbed his victim, 54-year-old Rafael Pena. He was taken by another co-worker to a local hospital where he died later that night. Nicasio-Ramirez was arrested at the scene.

Nicasio-Ramirez is scheduled for sentencing Aug. 8, 2018.

Assistant District Attorney James Bavero prosecuted the case.
