July 8, 2013 -- Westchester County District Attorney Janet DiFiore announced that Richard Rodriguez (DOB 01/14/81) of 4600 9Th Avenue, Brooklyn, New York, was arraigned on a Felony Complaint charging him with:

  • one count of Rape in the Third Degree, a class “E” Felony.

At the time of the incident, Dec. 23, 2013, the defendant was correction officer at the Bedford Hills Correctional Facility in Bedford Hills, New York.

While on duty at that facility, he engaged in sexual intercourse with an inmate who was incapable of consent because she was committed to the care and custody and supervision of the State Department of Corrections and Community Supervision (DOCCS) and the defendant was at the time an employee.

The New York State Inspector General’s Office and the Department of Corrections and Community Supervision contacted the New York State Police regarding the incident in February of 2014.

The New York State Inspector General’s Office the Department of Corrections and Community Supervision the New York State Police and the Sex Crimes Bureau of the District Attorney’s office investigated the allegations.

Rodriguez was suspended without pay on March 7, 2014 by the New York State Department of Corrections and Community Supervision.

The defendant surrendered to the New York State Police on July 7, 2014.

Bail was set at $500.

The defendant’s next court date is on Sept. 4, 2014.

The defendant faces a maximum of four years in prison.

Assistant District Attorney Fredric Green, Chief of the Sex Crimes Bureau, is prosecuting the case.
