April 18, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Frank Valencia of New Rochelle has been indicted by the Westchester County Grand Jury on the following charges:

  • Criminal Possession of a Weapon in the Second Degree, a class C felony
  • Attempted Assault in the First Degree, a class C felony

These charges stem from an incident Sept. 11, 2017. The indictment alleges, Valencia fired a weapon multiple times at a vehicle occupied by several people. No one was injured.

The defendant was arraigned today before Westchester County Court Judge Anne E. Minihan. ADA Nadine Nagler, Deputy Bureau Chief of the Career Criminal Bureau is prosecuting the case.

Valencia is also charged with the following felonies related to the shooting of a Yonkers Police Officer Sept. 25, 2017:

  • four counts of Attempted Aggravated Murder, a class A felony
  • four counts of Attempted Murder in the First Degree, a class A felony
  • one count of Criminal Possession of a Weapon in the Second Degree, a class C felony
  • one count of Assault in the Second Degree, a class D felony

Valencia’s alleged accomplice in the Sept. 25, 2017, shooting, Jerry Reyes (DOB 11/11/95), is charged with one count of one Criminal Possession of a Weapon in the Second Degree, a class C felony.

Background on the Sept. 25, 2017, shooting:
Indictments allege, Valencia was involved in the shooting of a Yonkers Police Officer. Around 8 p.m., two police officers responded to reports of a suspicious parked car at Marshall Road and Ridge Drive in the Park Hill section of Yonkers. As officers exited their patrol car and approached the vehicle occupied Valencia and Reyes, Valencia opened fire and one of the responding officers was struck in the jaw by a bullet. Backup arrived and while officers returned fire, the injured police officer was carried to a waiting ambulance and rushed to a nearby trauma center. The officer was released from the hospital two days later.

Valencia was injured in the shootout with police and taken to Westchester Medical Center where he was arraigned on charges of Attempted Murder. Reyes was arrested at the scene.

A loaded Glock 40 caliber semi-automatic handgun, a high-capacity magazine and numerous bullets were later recovered in the car occupied by the defendants at the Yonkers location where the shootout occurred.

Deputy District Attorney Perry Perrone, Chief of the Homicide Bureau, and ADA Nadine Nagler, Deputy Bureau Chief of the Career Criminal Bureau are prosecuting the cases.
