May 28, 2015 -- Westchester County District Attorney Janet DiFiore announced today that Carla Scott (DOB 05/10/80) of 20 N. 8th Avenue, Mount Vernon, New York, was arraigned today on a four count indictment charging her with:
- one count of Manslaughter in the First Degree, a class "B" Felony,
- one count of Manslaughter in the Second Degree, a class "C" Felony,
- one count of Leaving the Scene of an Accident which results Death, a class "D" Felony,
- one count of Criminal Possession of a Weapon in the Third, a class "D" Felony,
relating to the death of Glynis Pinto.
"Using a 3,500 vehicle to resolve a dispute over a man, as alleged in the indictment, has resulted in disastrous results for all involved. The victim spent the last seconds of her life clinging to the hood of a car, and now the defendant, will ultimately spend a good portion of her future in prison," said District Attorney Janet DiFiore.
On April 18, 2015 at approximately 5:27 p.m., the defendant, who was parked at the corner of Warburton and Babcock Avenues in Yonkers, drove her 2009 Mercedes Benz auto striking the victim, Glynis Pinto, who was standing in front of her car.
As a result, Ms. Pinto was launched onto the car's hood. The defendant continued to drive with Ms. Pinto hanging onto the hood for about 30 yards, until Ms. Pinto was thrust backwards onto the road, and both wheels on the right side of the vehicle ran over her resulting in Ms. Pinto sustaining multiple fractures and internal injuries causing her death.
The defendant fled the scene.
The defendant was arrested on April 22, 2015 after a joint effort by the Westchester County District Attorneys office, the Yonkers police department and FBI developed information regarding the defendant's whereabouts.
The defendant's remand was continued.
The case was adjourned to June 9, 2015.
She faces a maximum sentence of twenty five years in state prison.
Assistant District Attorney Christine O'Connor and Assistant District Attorney Kerrie Williams of the Superior Court Trial Bureau are prosecuting the case.

FORMER YONKERS NARCOTICS OFFICER SENTENCED ON HIS GUILTY PLEA TO PERJURY AND OFFICIAL MISCONDUCT

May 28, 2015 -- Westchester County District Attorney Janet DiFiore announced that Neil Vera (DOB 04/13/80) of 104 South Broadway, Yonkers, New York was sentenced today to six months of weekends at the County Jail on his April 23, 2015 guilty plea to:
- one count of Perjury in the Second Degree, a class "E" Felony,
- two counts of Official Misconduct, class "A" Misdemeanors.
On March 21, 2014, the defendant, a former Yonkers Police Department Narcotics Unit police officer acting in concert with:
Christian Koch (DOB 06/27/75) of 104 South Broadway, Yonkers, New York who was charged with:
- one count of Perjury in the Second Degree, a class "E" Felony,
- one count of Official Misconduct, a class "A" Misdemeanor,
swore falsely, and the false statement was made in an application for a search warrant for "141 School St., Apt. #3, Yonkers, New York". The false statement was made with intent to mislead a Yonkers City Court Judge in the performance of his official functions signing the warrant.
Additionally, on May 20, 2014, Police Officer Vera asked a person identified to the Grand Jury to lie to investigators and provide a false written statement to police officers of the Internal Affairs Division of the City of Yonkers Police Department.
He asked that individual to make a false statement to the Yonkers Police Internal Affairs investigators identifying himself/herself as an individual who had performed controlled narcotics buys at 141 School Street in support of the search warrant, when in fact this was completely false.
The defendants surrendered to the Yonkers Police Department Internal Affairs Division.
Koch also pled guilty on April 23, 2015 and will be sentenced on Sept. 10, 2015.
Assistant District Attorney Berit Huseby and Assistant District Attorney Brian Fitzgerald of the Public Integrity Bureau are prosecuted the case.

MOUNT VERNON CAREER CRIMINAL SENTENCED FOR ASSAULTING A POLICE OFFICER

May 20, 2015 -- Westchester County District Attorney Janet DiFiore announced that Leroi Bouche (DOB 02/13/87) of 42 Sheridan Avenue, Mount Vernon, New York was sentenced today to nine years in prison on his March 2015 guilty plea to:
- one count of Attempted Aggravated Assault on a Police Officer, a class "C" Felony.
On June 6, 2014, at approximately 7:15 a.m. at the rear parking lot of 630 East Lincoln Ave., in Mount Vernon, the defendant drove a motor vehicle at a high rate of speed at a Yonkers police detective who along with other members of WDANI – Westchester District Attorney's Narcotics Initiative were attempting to effect a car stop.
The detective was clearly identified by his clothing as a police officer and did identify himself as a police officer to the defendant and did order the defendant to stop the vehicle prior to the defendant accelerating the vehicle and striking the detective, seriously injuring him.
He was taken to Jacobi Medical Center in the Bronx where he remained for several days.
The defendant fled the scene on foot and was located and arrested on June 12, 2014 in the Bronx.
Assistant District Attorney John O'Rourke, Major Case Coordinator and Assistant District Attorney Laura Murphy of the Superior Court Trial Division prosecuted the case.

FORMER BANK MANAGER SENTENCED FOR STEALING OVER 1.4 MILLION DOLLARS FROM DEPOSITORS

May 20, 2015 -- Westchester County District Attorney Janet DiFiore announced today that Maria Rodriguez (DOB 05/23/68) of 88 Beverly Rd., Mt. Kisco, New York was sentenced today to two and one third to seven years in prison on her February 2015 guilty plea to:
- one count of Grand Larceny in the First Degree, a class "B" Felony,
- one count of Grand Larceny in the Second Degree, a class "C" Felony,
- one count of Criminal Tax Fraud in the Third Degree, a class "D" Felony,
Beginning in June 2008, the defendant who was employed as the Branch Manger of the M&T Bank retail branch in the Village of Ossining, began systematically stealing from two of the bank's customers.
The defendant knew the first victim since the mid 1990's.
She trusted the defendant to assist her with her personal banking and banking for her business. Over the course of five years, the defendant stole money from the victim by writing unauthorized checks to cash, making unauthorized cash withdrawals, and requesting an ATM card and making unauthorized ATM withdrawals. The total larceny for this victim is $1,112,127.40.
The second victim is 92 years old and a former Ossining Village police officer.
He would deal only with her at the bank. He thought he was withdrawing only the interest out of his bank account, when in fact the defendant was making unauthorized withdrawals worth thousands of dollars over a several year period. The total larceny for this victim is $192,144.00.
The thefts came to light when several of the defendant's subordinates at the Ossining Branch called M&T Bank's whistleblower hotline to report suspicious activity. M&T Bank then initiated an internal investigation, which led the bank to refer the matter to the Ossining Village Police Department, who in turn contacted the District Attorneys office.
In addition the New York State Tax Department assisted in investigating the tax charges.
In addition to incarceration, the defendant has restitution judgment orders for the victims and New York State Tax.
Assistant District Attorney Robert Mayes of the Economic Crimes Bureau prosecuted the case.

KILLER SENTENCED IN MOUNT VERNON NEIGHBORHOOD “GRANDMOTHER” MURDER

May 14, 2015 -- Westchester County District Attorney Janet DiFiore announced that Lloyd Lewis aka "Blue" (DOB 02/25/82) of 340 South 6th Ave., Mount Vernon, NY was sentenced today to twenty-two years to life on his March 2015 guilty plea to:
- one count of Murder in the Second Degree, a class "A" Felony,
relating to the death of 85-year-old Emma Gruber.
On Monday Feb. 10, 2014 at approximately 9 a.m.. Emma Gruber went to the Dole Senior Center in Mount Vernon via the Senior Center bus. At 2:30 p.m. the bus dropped Emma Gruber off at her home.
That was the last time anyone saw Emma Gruber alive.
Concerned neighbors and relatives began searching for the victim without success.
The next day, a worried grandson, went to Gruber's house looking for her.
On Feb. 11, a relative filed a Missing Persons Report at MVPD.
The next day, Feb. 12, Mount Vernon Detectives responded to Gruber's house to look for her.
They located the victim's body at the bottom of the basement stairs, under a large pile of clothes and a piece of plywood.
A nearby 2x4 piece of wood had the victim's blood on it.
The basement had a small flood because Gruber's water meter and copper pipes had been cut out and removed from the basement.
Also missing from Gruber's home was the 32" flat screen TV that the concerned relative observed on the day before.
The victim's death was later ruled a homicide by blunt force trauma of body with intermeningeal hemorrhages and contusion of the brain.
As the investigation into the homicide progressed, it was determined that the defendant had been fencing various items taken from the victim's residence:
- pieces of jewelry were sold at a pawn shop,
- a water meter, pipes, cords, a brass pitcher and a brass elephant statue were sold to a scrap yard.
On Monday, March 3, 2014 the defendant was arrested and charged with burglary in the third degree for burglarizing a detached garage of a nearby abandoned home at 359 South Seventh Ave.
This house, the defendant's house and the victim's house are all in the 300 Block on the South Side of Mount Vernon. The location of the burglarized garage is one block behind Lewis's house and five houses down.
A resident of a nearby house saw the defendant walking down the driveway and then coming back out with a red suitcase. The resident called 911. When the police arrived, they stopped Lewis at the intersection of South Seventh Avenue and West Fifth Street.
He was subsequently arrested.
Assistant District Attorney Christine O'Connor and Assistant District Attorney Jean Prisco of the Superior Court Trail Division prosecuted the case.
