Jan. 16, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. today announced that Frank Valencia of New Rochelle, NY was arraigned on a Grand Jury indictment and charged with Attempted Aggravated Murder in connection with the Sept. 25 incident that resulted in a Yonkers police officer being shot in the jaw.

Valencia (DOB 6/22/99), who was arraigned before Judge George Fufidio, was charged with:

  • four counts of Attempted Aggravated Murder;
  • four counts of Attempted Murder in the First Degree;
  • one count of Criminal Possession of a Weapon in the Second Degree;
  • one count of Unlawful Possession of a Large Capacity Ammunition Feeding Device; and
  • one count of Assault in the second Degree

Valencia’s accomplice, Jerry Reyes (DOB 11/11/95), was also arraigned and charged with:

  • one count of Criminal Possession of a Weapon in the Second Degree; and
  • one count of Unlawful Possession of a Large Capacity Ammunition Feeding Device

On Sept. 25, 2017, two police officers responded to reports of a suspicious parked car at Marshall Road and Ridge Drive in the Park Hill section of Yonkers. As officers exited their patrol car and approached the vehicle occupied Valencia and Reyes, Valencia suddenly opened fire and one of the responding officers was struck in the jaw by a bullet. Backup arrived and while officers returned fire, the injured police officer was carried to a waiting ambulance and rushed to a nearby trauma center.

Valencia was also injured in the shootout with police and taken to Westchester Medical Center where he was arraigned on charges of Attempted Murder. Reyes was also arrested at the scene.

A loaded Glock 40 caliber semiautomatic handgun, a high-capacity magazine and numerous bullets were later recovered in the car occupied by the defendants at the Yonkers location where the shootout occurred.  

Both defendants pled not guilty.

Their next court date is Jan. 30, 2018.

Valencia faces life in state prison, while Reyes faces up to 15 years.

Deputy District Attorney and Chief of the Homicide Bureau Perry Perrone and Bureau Chief Nadine Nagler of the Career Criminal Bureau are prosecuting the case.
