May 22, 2013 -- Westchester County District Attorney Janet DiFiore announced today that an eight count indictment was unsealed against Daniel Forte (DOB 04/14/87) of 817 Terrence Place, Cortlandt Manor, New York charging him with:
- one count of Murder in the First Degree, a class "A-1" Felony,
- two counts of Murder in the Second Degree, class "A-2" Felonies,
- two counts of Robbery in the First Degree, class "B" Felonies,
- two counts of Criminal Possession of a Weapon in the Second Degree, class "C" Felonies,
- one count of Robbery in the Second Degree, a class "C" Felony.
Enrique Ansell (DOB 10/07/86) of 126 Valley Street, Sleepy Hollow, New York was arraigned today on an five count indictment charging him with:
- one count of Murder in the Second Degree, a class "A-2" Felony,
- two counts of Robbery in the First Degree, class "B" Felonies,
- one count of Criminal Possession of a Weapon in the Second Degree, a class "C" Felony,
- one count of Robbery in the Second Degree, a class "C" Felony,
relating to the death of Kujtim Rushiti.
On Jan. 26, 2013 at approximately 8 p.m. in the area of Oak and Warren Avenues in Greenburgh, the defendants were engaging in a robbery of a sizable amount of marijuana.
The defendants insisted on weighing it before the purchase.
At the same time, four individuals arrived on the scene with the marijuana.
A number of participants then walked toward the front stoop of 172 Warren Ave. ostensibly to go into the location to weigh the drugs.
At this point Forte pulls out a handgun and strikes the seller.
The seller calls out to his friends who exit their vehicle and rush towards their friend who was down on the ground.
As they went to their friend's aid, Forte fires directly at the victim, striking him in the neck.
His friends drag him back to their vehicle and call police.
The victim was taken to Westchester Medical Center and subsequently died.
Greenburgh police and the District Attorneys office initiated an extensive investigation, processing the crime scene, interviewing witnesses, forensically analyzing cell phone movements, thereby quickly developing information on the defendants and their movements after the shooting.
Both defendants were subsequently arrested by Greenburgh detectives.
Both defendants have been remanded.
Their next court date is June 11, 2013.
Forte faces a maximum sentence of life in state prison on the top count in his indictment and Ansell faces twenty five years to life on the top count of his indictment.
Assistant District Attorney Christine O'Connor, Chief of the Narcotics and Firearms Bureau is prosecuting the case.
