May 21, 2013 -- Westchester County District Attorney Janet DiFiore announced that Sheldene Campbell (DOB 8/24/71) of 16 Ormian Drive, Pomona, New York, was found today to be not competent for sentencing on her Dec. 19, 2011 conviction after a jury trial on all six counts in the indictment that charged her with:

  • one count of Murder in the Second Degree, a class "A" Felony,
  • one count of Attempted Murder in the Second Degree, a class "A" Felony,
  • one count of Attempted Assault in the First Degree, a class "C" Felony,
  • one count of Leaving the Scene of an Incident Without Reporting, a class "D" Felony,
  • one count of Leaving the Scene of an Incident Without Reporting, a class "A" Misdemeanor,
  • one count of Assault in the Third Degree, a class "A" Misdemeanor.

for the October 2008 death of Marie Bucci and injury to Roseanne Schiavone.

The ruling is a result of a New York State Criminal Procedure Law 730.30 mental competency examination.

Following numerous and extensive bedside hearings conducted by the Court with all parties present and including testimony from two neurologists, three psychologists, hospital nursing staff and Correctional personnel, the defendant who is bedridden and on a feeding tube and trach collar, has been found incompetent to proceed for sentencing at this time.

As a result, the defendant will now be committed to the custody of the New York State Office of Mental Health for confinement.

On Oct. 19, 2008, at approximately 11 a.m., Roseanne Schiavone was walking her dog in the vicinity of 205 Havilands Drive in White Plains, when, behind her, she heard the revving of a car engine.

As she tried to get out of the way of the oncoming car, she was struck by the vehicle.

The vehicle, which should have been traveling on the right side of the road was not, striking Mrs. Schiavone on the left side of the road.
The dog, which she was walking, also was injured suffering a broken hind leg.

The vehicle continued up Havilands Drive at a high rate of speed.

At the intersection of Baylor Circle and Havilands Drive, Marie Bucci, who was out for a walk, was struck.
Witnesses called 911 - responding EMS technicians transported Mrs. Bucci to White Plains Hospital where she was declared dead at approximately 11:30 a.m.

The defendant continued to drive at a high rate of speed up Havilands Drive exiting at North Street.

Shortly thereafter, White Plains police located the defendant walking in the area of Bryant and South Lexington Avenues.

Her vehicle, with obvious damage, was parked nearby.

After preliminary questioning, she was taken to headquarters and was placed under arrest.

Assistant District Attorneys Christine O'Connor and Kerrie Williams of the Superior Court Trial Division prosecuted the case.
