Jan. 22, 2013 -- Westchester County District Attorney Janet DiFiore and New York State Inspector General Catherine Leahy Scott announced that Raymond Encarnacion (DOB 03/10/84) of 480 East 188 Street, Bronx, New York was arraigned today on a Felony Complaint charging him with:
- one count of Grand Larceny in the Fourth Degree, a class “E” Felony.
Between Aug. 2, 2012 and Nov. 8, 2013, at various times, the defendant who was employed by the New York State Power Authority as a Services Assistant, fraudulently signed out NYPA issued gas cards that were designated for use only in power authority vehicles to which the cards were assigned.
He then used the various gas cards for his own personal use, without the knowledge or consent of NYPA, with the result that he stole $2,918.41 in public funds from NYPA.
An internal audit by the Power Authority pointed to discrepancies in the use of the various gas cards.
The New York State Office of Inspector General was contacted and commenced an investigation in conjunction with the District Attorneys office. The defendant surrendered yesterday.
“This defendant, as alleged in the Complaint, showed a brazen disregard not only for his employer, but also for all New York Taxpayers. His continuing use of the gas cards, as if he was legitimately entitled to the fuel, only adds to the larceny,” said District Attorney Janet DiFiore.
“This arrest demonstrates that we will hold state employees accountable for acts contrary to their public service and responsibilities,” said Inspector General Scott. “I will continue to work with our state agencies and prosecutors and combat such fraud and abuse.”
Bail was set at $2,000 cash or bond.
His next court date is Feb. 26, 2014.
He faces a maximum sentence of four years in state prison.
Assistant District Attorney Brian Conway, Deputy Chief of the Public Integrity Bureau is prosecuting the case.
