Prior to being named Chief Assistant District Attorney in 2017, First Deputy District Attorney James McCarty served as Acting District Attorney for one year after former DA Janet DiFiore vacated her position and became New York’s Chief Judge.

Before becoming Acting District Attorney, Mr. McCarty served as the Chief of Trial Operations for 10 years where he oversaw all trials in the superior and local courts in Westchester. A 35-year career prosecutor, Mr. McCarty was originally appointed as an Assistant District Attorney by District Attorney Carl A. Vergari and served in the Motions and Appeals Division, the Investigations Division and the Superior Court Trial Division. Mr. McCarty was promoted by District Attorney Vergari to Bureau Chief within the Superior Court Trial Division.  He continued in the Superior Court Trial Division during the tenure of District Attorney Jeanine Pirro, who promoted him to Deputy Division Chief.

Mr. McCarty has tried more than 100 cases, including the successful prosecutions of Carolyn Warmus, the so-called "Fatal Attraction" murder case, and serial killer Patrick Baxter. 

Mr. McCarty is a graduate of the University of Rochester and Albany Law School.
