Nov. 27, 2012 --  Westchester County District Attorney Janet DiFiore announced that Victor Hernandez (DOB 10/31/85) of 1070 Fox Street, Bronx, New York pled guilty today to:

  • one count of Robbery in the First Degree, a class “B” Felony,

relating to a 2009 home invasion robbery in the Town of Greenburgh.

Dec. 20, 2009 the defendant, who was armed with a knife, along with two unidentified accomplices, forced their way into a house in Greenburgh and proceeded to tie up the husband and wife who were home at the time.

The men stole a number of items from the home: cash, jewelry, flat screen TV and a laptop computer.

The Greenburgh police were notified and an investigation began.

After an extensive investigation involving the Greenburgh Police Department and the Organized Crime and Criminal Enterprise Bureau of the District Attorney’s Office, the stolen laptop was ultimately located – almost two years later - in the Bronx.

The couple’s son, an IT manager, had previously installed software that allowed him to access the laptop when it was powered on. Evidently the defendant gave the laptop to his girlfriend who continued to use it, unaware of its origin. Photos downloaded by the son remotely from the stolen laptop had several photos of defendant.

Greenburgh Police went to the Bronx location and learned that the defendant was in jail in Michigan on unrelated burglary charges.

In the intervening time between the Greenburgh home invasion and the defendant’s identification and indictment in Westchester, the defendant was also incarcerated in Indiana for burglary and deported twice.

A warrant for his arrest was issued on Jan. 23, 2012.

The defendant waived extradition back to New York where he was arraigned on May 9, 2012 after the indictment was unsealed.

Following today’s guilty plea, District Attorney Janet DiFiore said, “Advances in computer technology, tenacious detective work by the Greenburgh police and forensic support work by the Organized Crime and Criminal Enterprise Bureau of my office resulted in this serial home invader being identified, subsequently located and indicted for a truly frightening and violent home invasion.”

The defendant will be sentenced on Jan. 24, 2013.

Assistant District Attorney Livia Rodriguez of the Organized Crime and Criminal Enterprise Bureau prosecuted the case.
