Date, 2012 -- Westchester County District Attorney Janet DiFiore announced today that Deshawn Manners

(DOB 09/07/79) of 35 Cliff Street, Yonkers, New York, was arraigned on a five count indictment charging him with:

  • one count of Attempted Rape in the First Degree, a class "C" Felony,
  • two counts of Sexual Abuse in the First Degree, class "D" Felonies,
  • one count of Assault in the Second Degree, a class "D" Felony,
  • one count of Strangulation in the Second Degree, a class "D" Felony.

On June 18, 2012 at approximately 3 a.m., the defendant followed the 53-year-old victim for several blocks from Getty Square to Park Avenue as she walked in the direction of her home.

The defendant then attacked the woman from behind, choking her until she became unconscious.

When the victim came to, the defendant ripped her blouse open and sexually assaulted her.

The woman's cries for help alerted a nearby homeowner who called 9-1-1.

Police arrived quickly and saw the defendant attacking the woman, but he fled on foot and was not apprehended.

The victim was taken to a nearby hospital for treatment and police began an investigation.

A DNA sample collected as part of the investigation was entered into CODIS, the national Combined DNA Index System and a match was made to this defendant's existing profile.

The defendant was arrested on Oct. 22 as he left the Westchester County Jail after serving a sentence for a prior conviction.

The defendant remains held without bail and is due back in court on Jan. 22, 2013.

After the arraignment, District Attorney Janet DiFiore said, "DNA and detective work came together to identify and apprehend this defendant. Although the victim repeatedly attempted to escape, the defendant was relentless in his attack resulting in serious physical and emotional trauma to the victim."

The defendant faces a maximum sentence of 15 years in state prison if convicted.

Assistant District Attorney Fredric Green, Chief of the Sex Crimes Bureau, is prosecuting the case.
