Dec. 4, 2012 -- Westchester County District Attorney Janet DiFiore announced that Waverly Patrick a/k/a Patrick Waverly (DOB 06/06/59) of 2 Hudson Street, Yonkers, New York, was arraigned today on a seven count indictment charging him with:

  • one count of Vehicular Manslaughter in the First Degree, a class "C" Felony,
  • two counts of Vehicular Manslaughter in the Second Degree, a class "D" Felony,
  • one count of Leaving the Scene of an Incident Without Reporting, a class "D" Felony,
  • two counts of Driving While Intoxicated, unclassified misdemeanors,
  • one count of Aggravated Driving While Intoxicated, an unclassified Misdemeanor,

relating to a fatal motor vehicle accident.

On June 22, 2012, the defendant was driving westbound on Valentine Lane in Yonkers at approximately 9:28 pm when his Jeep Cherokee struck the victim, who was waiting to cross the street with a 15 year old friend on their way to nearby store.

The impact threw the victim, 16 year old Keyairra Price, on to the sidewalk, resulting in life-threatening injuries.

Witnesses observed the defendant's vehicle continue without stopping toward the intersection of Valentine Lane and Riverdale Avenue.

An ambulance took the victim to Jacobi Medical Center in the Bronx where she later died.

Yonkers Police began an extensive search for the vehicle, and located it several hours later in a parking lot outside the defendant's apartment building.

The defendant was subsequently located and questioned.

A court order was obtained and the defendant's blood alcohol level was found to be in excess of .18, more than twice the legal limit of .08.

The defendant was arrested.

He remains held without bail and is due back in court on Dec. 19, 2012.

The defendant faces a maximum sentence of 15 years in state prison if convicted.

Assistant District Attorney John O'Rourke, Chief of the Major Case Bureau, is prosecuting the case.
