Defendants: Joseph Ogilvie (DOB 03/12/92); Tremaine Gordon ((DOB 07/16/91)

May 21, 2019 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced two Mount Vernon gang members were sentenced to terms in state prison for assaulting a third man in April 2016. Joseph Ogilvie and Tremaine Gordon were convicted by a Westchester County jury in March following a trial before Judge George Fufidio.

Specifically, they were sentenced to the following:

Ogilvie:

• Attempted Assault in the First Degree, a class C violent felony – 10 years in state prison and five years’ post-release supervision
• Assault in the Second Degree, a class D violent felony -- five years in state prison and three years’ post-release supervision
• Criminal Possession of a Weapon in the Fourth Degree, a misdemeanor – one year in prison

All sentences will run concurrent. Ogilvie was sentenced May 14, 2019.

Gordon:

• Attempted Assault in the First Degree, a class C violent felony – 10 years in state prison and five years’ post-release supervision
• Assault in the Second Degree, a class D violent felony -- five years in state prison and three years’ post-release supervision
• Criminal Possession of a Weapon in the Fourth Degree, a misdemeanor – one year in prison

All sentences will run concurrent. Gordon was sentenced today (May 21, 2019).

Background
On April 28, 2016, at approximately 3 a.m. in the vicinity of Gramatan and West Sidney avenues in Mount Vernon, the victim was in a verbal confrontation on a public sidewalk with both defendants, Joseph Ogilvie and Tremaine Gordon. As the victim entered a vehicle and attempted to leave the area, the defendants approached the victim and stabbed him multiple times.

The victim fled and was later found injured in the Bronx by members of the New York Police Department (NYPD). The victim was rushed to Jacobi Medical Center where he was treated for his injuries.

These defendants are both members of a violent street gang in the City of Mount Vernon, known the GMG gang (“Get Money Gangstas”), however, at times, they have referred to themselves as the “Hunnit Hustle Gang.”   The case was prosecuted by the Investigations Division Gang, Firearms and Narcotics Bureau.

 In compliance with the Rules of Professional Conduct, Rule 3.6, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
