Defendant: Shawn Weaver (DOB 07/15/84)

March 6, 2019 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Shawn Weaver was found guilty Tuesday by a Westchester County Jury for assaulting and robbing another Yonkers man. Westchester County Court Judge Susan Cacace presided.

Specifically, Weaver was found guilty of the following:

• Assault in the First Degree, a class B violent felony
• Robbery in the First Degree, a class B violent felony
• Two counts of Criminal Possession of a Weapon in the Third Degree, a class D felony

The defendant faces a maximum of 30 years in State Prison when sentenced May 7, 2019.

Background
The incident took place March 16, 2018, inside a Yonkers apartment where both the victim and his girlfriend lived and where her adult son would sometimes stay. At approximately 11:20 p.m., the victim, a man in his sixties, was counting the money from his pockets before preparing for bed. His girlfriend was already sleeping.

The defendant, Shawn Weaver, the girlfriend’s 33-year-old son, approached the victim and accused him of hitting or pushing his mother. The victim denied the allegation and Weaver began to beat him first with a piece of wood from a broken piece of furniture and a clothing iron.

Weaver struck the victim in his side with the wood, sending him to the floor. He then punched and stomped the victim and hit him in the left eye area multiple times, including with the iron.

During the beating, defendant stole approximately $350 from the victim’s hand. 

When Police Officers arrived, they found the victim on the ground unconscious but breathing. Weaver had fled the scene. The victim was taken to Jacobi Medical Center where doctors operated on his injured eye. He needed an additional surgery two months later to correct other issues with his sight. 

Yonkers Police arrested Weaver a few weeks after the incident.

Assistant District Attorneys Craig Ascher of the Superior Court Trial Division, Michelle Calvi of the Grand Jury Bureau, and Maria Wager, Chief of the Motions Bureau, prosecuted the case.
