Defendant:  Heriberto Morales (DOB 12/07/85)

June 14, 2019 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Heriberto Morales of Yonkers was sentenced for the murder of Timothy Conkling, a driver for a private carting company who was stepping into his truck when he was shot in Yonkers in March 2018. Supreme Court Judge Barry Warhit presided. Morales was indicted for the murder by a Westchester County Grand Jury July 19, 2018. He pleaded guilty to both counts in April.

Specifically, Morales was sentenced to the following:

• Murder in the Second Degree, a class A violent felony—19 years to life in state prison
• Criminal Possession of a Weapon in the Second Degree, a class C felony—16 years to life in state prison.

Both sentences will run concurrently (at the same time).

In the courtroom today, Conklin’s wife and two daughters made emotional statements regarding the impact his murder had on their lives and the deep loss they have suffered. Mrs. Conklin told the defendant, “While 19 years may seem long to you and your family, you will still breathe, eat, have visits and phone calls with your loved ones while our family will have to learn to cope with the silence.”

Background
On March 1, 2018, Timothy Conkling’s body was found on Ashburton Avenue in Yonkers around 10:50 a.m.

The 36-year-old had one gunshot wound to his head. At the time of his death, he was a driver for a private carting company. Morales shot the driver from an apartment window adjacent to the parking lot where Conkling’s truck was parked. Yonkers Police arrested Morales that same day.

Video surveillance helped Yonkers Police piece together how the shooting happened and how Morales made his way from the scene.

Assistant District Attorneys Christine O’Connor, Chief of the Homicide Bureau, and Kerrie Williams, Deputy Chief of the Sex Crimes Bureau, prosecuted the case.
