Defendant: Rahul Masih (DOB 10/20/74)

Aug. 20 2020 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced Rahul Masih, of Yonkers was sentenced last week for using a fraudulent identity to steal falsely purchased appliances from a Westchester store.

He pleaded guilty on Oct. 20, 2019,  to Attempted Criminal Possession of a Forged Instrument in the second degree, a class E felony. He was sentenced before Westchester County Court Judge David Zuckerman (Aug.12, 2020) to five years’ probation with $2,580.00 restitution paid to the victim, Atlantic Appliance of Yorktown, NY.

Background
On Aug. 3, 2018, the defendant, Rahul Masih, received an appliance to be delivered to a Park Avenue, Yonkers address that had been purchased with a fraudulent credit card. Just two days earlier, the defendant received a delivery a few houses away from that address of a similar purchase with the same company. He claimed the appliance was for renovations. When the employees arrived to make the second delivery, they were suspicious because they recognized Masih and the close proximity of the two locations.

The delivery team called the police and detained the defendant until Yonkers Police arrived and arrested Masih.

The payment for the first delivery had been reversed for fraud. Masih was found to have a forged Pennsylvania driver’s license bearing his picture which was the basis for the charged crime.

Investigations Division Assistant District Attorney Adrian Murphy of the Identity Theft Unit is prosecuting the case.
