WHITE PLAINS, N.Y. – Westchester County District Attorney Susan Cacace announced today that Yonkers resident Ludvin Ramos-Cervantes will serve at least 12 years in state prison for fatally shooting 51-year-old Francisco Gordillo in 2024.

Last month, Ramos-Cervantes, 19, was convicted at trial of Manslaughter in the Second Degree and Criminal Possession of a Weapon in the Second Degree for killing Gordillo.

On Friday, Judge Maurice D. Williams sentenced Ramos-Cervantes to 12 years in state prison, plus 5 years of post-release supervision, on the weapons charge, and 5 to 15 years in state prison on the manslaughter charge, the maximum penalty allowable, with both sentences to run concurrently.
  
DA Cacace said: “Mr. Gordillo’s death was completely avoidable. The defendant’s decision to introduce a gun into this situation fundamentally altered the course of their lives. Now, he will be held accountable for his reckless conduct.”

On Feb. 26, 2024, at approximately 4:45 a.m., Ramos-Cervantes was a passenger in Gordillo’s vehicle as Gordillo drove him home after a night out drinking. Upon arrival, Ramos-Cervantes entered his apartment briefly and returned to the car with a .45 caliber pistol.

Ramos-Cervantes then wrapped his arm around Gordillo and shot him in the head. Gordillo was pronounced dead on scene. Ramos-Cervantes initially claimed to police that Gordillo had died by suicide and then later claimed the gun had been fired by accident.

The investigation was conducted by the Yonkers Police Department. DA Cacace thanks the Westchester County Department of Labs and Research’s Division of Forensic Sciences and the Westchester County Police Department's Ballistics Unit for their assistance with this case.

The case was prosecuted by Bureau Chief Jonathan Strongin and Assistant District Attorney Leigh Wellington.
