Oct. 11, 2012 -- Westchester County District Attorney Janet DiFiore announced that three members of the GMG gang who operate in the area of 13th Avenue in the City of Mount Vernon, New York were arraigned today on an indictment charging:

 

Tyron McCallum (DOB 04/08/87) of 603 S. 6th Avenue, Mount Vernon, New York with:

  • one count of Attempted Murder in the Second Degree, a class “B” Violent Felony,
  • one count of Assault in the First Degree, a class “B” Violent Felony,
  • two counts of Criminal Possession of a Weapon, in the Second Degree, a class “C” Felony.

Travis Clarke (DOB 09/09/89) of 130 W. 4th Street, Mount Vernon, New York and Kristopher Benjamin (DOB 08/31/88) of 34 S. 3rd Avenue, Mount Vernon, New York with:

  • one count of Attempted Murder in the Second Degree, a class “B” Violent Felony,
  • one count of Assault in the First Degree, a class “B” Violent Felony,
  • one count of Criminal Possession of a Weapon in the Second Degree, a class “C” Felony.

On July 25, 2012, at approximately 9:03pm, the defendants, acting in concert, fired ten shots from a semi-automatic pistol at a vehicle traveling on East Sidney Avenue near the intersection of North Columbus Avenue in the City of Mount Vernon in an attempt to kill the occupants.

One bullet struck an unrelated vehicle traveling on East Sidney Avenue, penetrating the car and seriously injuring a 65 year old female passenger.

Following a two month investigation by Mount Vernon police and investigators from the Westchester County District Attorneys office, the defendants were identified and arrested.

They were indicted last week.

“The residents of the City of Mount Vernon should not feel that the streets are a place of constant fear as their community is held hostage by handgun violence,” said District Attorney Janet DiFiore after the defendants were arraigned. “Block by block, neighborhood by neighborhood we are committed to reducing violent crime and aggressively targeting the lethal combination of gangs and guns which is essential in making a safe community a reality for everyone in the City of Mount Vernon and Westchester County.”

Bail for McCallum was set at $500,000 cash/bond.

Bail for Clarke was set at $500,000 cash/bond.

Benjamin was remanded to the County Jail.

Their next court appearance will be on Oct. 23, 2012.

They face a maximum sentence of 25 years in state prison on the top counts of the indictment.

Assistant District Attorney Patricia Murphy, Deputy Division Chief of the Superior Court Trial Division and Assistant District Attorney John O’Rourke Bureau Chief of the Major Case Bureau are prosecuting the case.
