Defendant:  John Nemec (DOB: 03/06/1971)

Sept. 7, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced that a one-time fugitive from justice, John Nemec of Yonkers, pleaded guilty Thursday to grand larceny charges before Westchester County Court Judge Barry Warhit for defrauding three victims of more than $190,000.

Specifically, Nemec pleaded guilty to:

  • one count of Grand Larceny in the Second Degree, a class C felony
  • two counts of Grand Larceny in the Third Degree, class D felonies

Sentencing is scheduled for Dec. 6, 2018.

Background
The indictment alleges that John Nemec conspired and engaged in a fraudulent investment scheme to steal over $190,000 from his victims. To carry out the scheme, Nemec first fraudulently induced his victims to trust him, and then he stole their money.  He told his victims that he left his short-lived employment as a police officer years ago to become a financial success in both the film industry and as a stock trader.  He showed one victim a fraudulent investment account statement falsely stating that Nemec had over $58,000,000.00 (58 million dollars) in personal investments. Once Nemec gained their trust, he then convinced his victims to transfer their life savings to him and his co-conspirator under the guise that their money would be held and invested on their behalf.  Shortly after their savings were transferred, Nemec orchestrated the withdrawal of their money for his own personal use.

Between August 2010 and October 2010, Nemec stole approximately $50,285 of investment funds from his first victim. In May 2011, he stole approximately $4,900 from his next victim. Then, between June 2011 and October 2012, Nemec and his co-conspirator stole approximately $137,068 from his third victim.

In March 2014, after learning that the Westchester County District Attorney’s Office was investigating his crimes, Nemec began actively evading investigators and apparently fled to Spain at one point. Arrest warrants were issued by the Yonkers City Court March 28, 2014, and by the Westchester County Supreme Court Oct. 11, 2016.

Nemec was a fugitive from justice for more than two years. Through the persistence of and coordination between the Westchester County District Attorney’s Office and the Westchester County Department of Public Safety’s Warrant-Fugitive Unit, Nemec was located and apprehended May 2, 2018, in LaGrange, New York.

The case is being prosecuted by Assistant District Attorney Brian Fitzgerald, Deputy Bureau Chief of the Westchester County District Attorney’s Investigations Division Public Integrity Bureau.
