Sept. 10, 2013 -- Westchester County District Attorney Janet DiFiore announced that Christopher Earl (DOB 10/31/68) Homeless, of Yonkers, New York, was sentenced today to an indeterminate term of twenty-five years to life in prison on his May 2013 conviction after trial of:

• one count of Predatory Sexual Assault, a class "A-2" Violent Felony,
• one count Rape in the First Degree, a class "B" Violent Felony,
• three counts of Sex Abuse in the First Degree, class "D" Felonies,
• one count of Criminal Possession of a Weapon in the Third Degree, a class "D" Felony,
• one count of Endangering the Welfare of a Child, a class "A" Misdemeanor.

On Sept. 27, 2011, at approximately 8 p.m., the defendant went to the victim's home and asked if he could wait there a few minutes until his brother, also the victim's cousin, came to pick him up. The victim allowed the defendant to enter the apartment and wait while she continued to prepare dinner for her and her three-year-old daughter.

As the victim was continuing to prepare the dinner, the defendant picked up a kitchen knife and threatened her with the knife.

The defendant forced the victim at knife point into her bedroom, and holding the knife to the victim's throat and began to sexually abuse her. He continued the assault at which point he forcibly raped the victim.

He then fled the location.

The victim immediately disclosed the sexual assault to members of the Yonkers Police Department and identified her assailant.

After a police manhunt, aided by family members, the defendant was located and subsequently arrested by members of the New Rochelle Police Department.

"This defendant used and exploited the empathy and kindness of his cousin to rape and abuse her. Not only did he assault her, but all the while the victim's three year old daughter was in the next room further terrorizing her as to his ultimate motives, said District Attorney Janet DiFiore.

Assistant District Attorney Michelle Lopez, Deputy Chief of the Sex Crimes Bureau and Assistant District Attorney Michael Rubin prosecuted the case.
