PREDICATE FELONY OFFENDER SENTENCED IN YONKERS RAPE

 

 

 

Westchester County District Attorney Janet DiFiore announced that Robert McIntyre (DOB 05/21/69) of 10th Avenue, Brentwood, New York, was sentenced today to ten years in state prison after being convicted of one count of Rape in the First Degree, a class “B” violent Felony.

 

McIntyre is classified as a predicate violent felony offender for a previous conviction of Assault in the Second Degree a violent felony offense.

 

On July 22nd, 2006 at approximately 12:00 a.m. the victim left a neighborhood party in Yonkers, New York to purchase additional potato chips and soda.  While returning from the grocery store, the victim was approached by the defendant and an unidentified man who robbed her at knife point. 

 

The unidentified man fled with the grocery bags.

 

The defendant then forced the victim into a basement utility room, knocked her to the floor, pinned her with his knees and began beating her with his fists. 

 

He then tore the victim’s clothes off, sexually assaulted her and threatened to kill her if she reported the rape.  He then left the scene.

 

The victim was taken to St. Joseph’s Medical Center where Police took a statement from her and a rape kit was used to collect evidence of the attack which subsequently matched the defendant’s DNA.

 

McIntyre was located by Yonkers detectives and after further investigation was placed under arrest.
