SENTENCING IN THE SEXUAL ASSAULT OF A LINCOLN HALL YOUTH HOME COUNSELOR
Westchester County District Attorney Janet DiFiore announced today that Marcus Fraser (DOB 01/12/91) of 908 Boyland Street, Brooklyn, New York was sentenced today to ten years in state prison on his guilty plea to one count of Attempted Criminal Sexual Act in the First Degree, a class “C” Felony.
On September 17, 2007, at approximately 11 AM, at The Lincoln Hall School on Route 202 in Somers, Fraser met with his counselor, in her office, to discuss a discharge plan from Lincoln Hall.
At the end of the meeting, the defendant shook the victim’s hand and instead of leaving, locked himself and the victim in her office.
He then walked behind her desk where she was seated, trapping her in the corner of her office, exposing himself and demanding that she perform oral sex on him.
When she refused, he physically attacked her, punching her repeatedly on her face and body breaking her nose.
As a result of the victims constant screaming during the attack, several co-workers arrived and unlocked the door.
The defendant fled the scene.
State Police were called and apprehend the defendant.
In addition to his sentence of ten years in state prison, Fraser will be required to serve ten years post release sex offender supervision.
“Few types of crimes shatter a victim’s world in the manner a sexual assault can”, said District Attorney Janet DiFiore after the sentencing. “The victim in this case, a guidance counselor, who chose to help and work with troubled adolescents, has had her personal life and career shredded. The defendant has been sentenced to ten years in state prison. And because of his acts, the victim may suffer a sentence much longer than that.”
Assistant District Attorney Michelle Lopez, of the Sex Crimes Bureau, prosecuted the case.
