CONVICTION IN MOUNT VERNON STREET SHOOTING   

 

 

Westchester County District Attorney Janet DiFiore announced today that Enric Devers, Jr. (DOB 05/24/89) of 347 Huguenot Street, New Rochelle, New York was convicted of one count of Murder in the Second Degree, a class “A“ Felony and one count of Criminal Possession of a Weapon, in the Second Degree, a class “C” Felony.

 

On April 24, 2007, at approximately 8:55 p.m., Reginald Rogers, the victim, was walking east on 4th Street in Mount Vernon with his girlfriend and another friend. 

 

The victim’s friend subsequently turned onto Union Avenue and the victim and his girlfriend continued on 4th Street in the direction of the victim’s home. The defendant, along with a co-defendant and a friend, who were all members of the “Bloods” street gang, were on the opposite side of 4th Street when they observed the victim and his girlfriend.

 

The co-defendant, Robert Lewis (DOB 01/09/89) of 425 Terrace Avenue, Mount Vernon, New York, plead guilty to Murder in the Second Degree earlier this year, suggested to the defendant that they should shoot the victim, because he was a member of a rival gang, the “Crips”.

 

Upon approaching the victim and his girlfriend the co-defendant shot the victim five times, striking him in the left shoulder area, the back and the left thigh. As the victim lay wounded on the sidewalk, the defendant shot him once in the head. The defendant, co-defendant and their friend then fled the scene, running towards Union Avenue.

 

When members of the Mount Vernon Police Department arrived on the scene, a witness provided them with information regarding the shooting, descriptions of the three individuals and their direction of flight. 

 

Police recovered shell casings and bullets in the area where the victim had been shot and these items were subsequently transported to the Westchester County Police Department’s Ballistics Unit.

 

The victim, who had been transported to the Mount Vernon Hospital Center for treatment, was pronounced dead at approximately 12:25 a.m. on April 25, 2007.

 

On May 21, 2007, at approximately 6:20 p.m., members of the Mount Vernon Police Department set up a surveillance of the defendant’s home and subsequently observed the defendant exit his home and enter the passenger’s side of an automobile which had pulled up to that location.

 

After the vehicle drove off, the police followed it for a short period of time and stopped it in the vicinity of Webster Avenue and Eastchester Road, where the defendant was placed into custody.

 

Sentencing will be on July 1st, 2008.

 

Devers faces a maximum of twenty five years to life in state prison.
