GUILTY PLEA IN MOUNT KISCO

LEAVING THE SCENE AUTO DEATH

 

 

 

Westchester County District Attorney Janet DiFiore announced that David Rogonia (DOB 02/06/78) of 95 New Chalet Road, Mohegan Lake, New York plead guilty today to one count of Leaving the Scene of an Incident without Reporting, a class “D” Felony and one count of Criminally Negligent Homicide, a class “E” Felony.

 

On September 12, 2007, at approximately 11:00 P.M. Rogonia and the victim were driving in the vicinity of 201 West Main Street, in the Village of Mount Kisco, where the defendant lost control of his 1987 Mustang, causing it to roll over.

 

As a result of the roll over, the victim was ejected from the vehicle, sustaining a number of injuries which resulted in his death on September 13, 2007.

 

The defendant exited the vehicle after the roll over, saw that the victim was on the ground, apparently in an unconscious and injured state, and fled the scene without seeking help for the victim and without leaving his contact information.

 

A witness heard the crash and observed the defendant at the scene of the crash flee from the area.  Responding police located the defendant’s driver’s license. The officers showed the driver’s license to the witness who confirmed that the defendant was the man observed fleeing the area.

 

The defendant did not have any contact with law enforcement until September 13, 2007, when he surrendered himself at the Mount Kisco Police Department.

 

Rogonia will be sentenced on June 3rd, 2008.

 

He faces a maximum of seven years in state prison.
