for attempted rape of a 10 year old




Westchester County District Attorney Janet DiFiore announced that Robert Viggiano

(DOB 03/24/62) of 78 Maple Avenue, Fishkill, New York, was sentenced today to a determinate sentence of 3 ˝ years in state prison on his guilty plea of:


·         one count of Attempted Rape in the First Degree, a class “C” Felony.


The defendant, an electrical contractor, told a prostitute that he wanted to have sex with a 10 year old virgin, and asked if she could arrange it.


The prostitute reported the defendant’s request to Yonkers Police, who along with the Westchester County District Attorney’s Office, began an undercover investigation.


Over a period of a few weeks, the defendant had multiple conversations with an undercover police officer who was posing as the mother of the 10 year old girl.


They agreed on the transaction occurring at her apartment for $400 and that he would bring candy for the victim.


On February 8, 2011, the defendant arrived at a pre-arranged location with $400 in his pocket along with Starburst candy and a lollipop, thinking he was going to have sex with a 10 year old virgin and was arrested by Yonkers Police.


The court also imposed 10 years post-release supervision. Upon his release from prison, Viggiano is required to register as a sex offender under Meghan’s Law/Sex Offender Registry Act.


Assistant District Attorney Kenneth Borden of the Special Prosecutions Division prosecuted the case.
