Oct.14 , 2016 -- Acting Westchester County District Attorney James A. McCarty announced today that Michael Thomas a.k.a. Laquan Smith (DOB 05/06/86) of 288 Riverdale Avenue, Yonkers, NY, was sentenced to thirty years in state prison after having been found guilty on July 20, 2016 after a non-jury trial of:

  • two counts of Robbery in the First Degree, class “B” Felonies,
  • two counts of Assault in the First Degree, class “B” Felonies,
  • one count of Attempted Robbery in the First Degree, a class C” Felony,
  • two counts of Criminal Possession of a Weapon in the Third Degree, class “D” Felonies.

On July 8, 2015 at approximately 12:56 a.m., the defendant approached the victim in the vicinity of 189 Linden Street in Yonkers.

Thomas stabbed the victim in the heart while forcibly stealing the victim’s backpack. Just minutes before, the defendant tried to steal property from another victim at 120 South Broadway. He threatened that person with a knife as well.

The stabbing victim was taken to Jacobi Medical Center. Upon arrival there, the victim was unresponsive and had no pulse. An emergency thoracotomy, cardiac massage, two sequences of defibrillation and heart surgery were required to save his life.

After an intensive investigation by the Yonkers Police Department, the defendant was arrested that same day.

The defendant was remanded into the custody of the New York State Department of Corrections.

Assistant District Attorney Jean Prisco of the Superior Court Trial Division prosecuted the case.
