Nov. 16, 2016 -- Acting Westchester County District Attorney James A. McCarty announced today that Nashaun Hunter (DOB 07/29/98) of 4375 Bruner Ave., Bronx, NY, was sentenced to twenty-five years in state prison after having pled guilty to:

  • one count of Manslaughter in the First Degree, a class “B” Violent Felony

in the shooting death of Michael Nolan.

On Sept. 18, 2015 at approximately 12:38 a.m. in the area of 826 Central Park Ave., Yonkers, New York, the victim was standing outside of his black Mercedes loaner car in the parking lot of the Burger King Restaurant when a white Toyota Camry slowly rolled up alongside.

Inside the vehicle was the above named defendant along with co-defendants Tejmitra Singh, Darren Dawson and Garth O’Neil Cole. Suddenly, Hunter fired six shots from the back driver’s side window of the Camry one of which struck Michael Nolan in his head.

Nolan was brought to Jacobi Medical Center in the Bronx where he remained in a coma until he was declared dead on Oct. 9, 2015.

An extensive investigation was carried out by the Westchester County District Attorney’s Office, the Yonkers Police Department and the Westchester County Intelligence Center. That investigation revealed that the shooting was in retaliation for the beating of an individual known to the defendant and related to events that began during a drag race two nights before the shooting.

Detectives found .25 caliber shell casings at the scene. A .25 caliber bullet was recovered from the victim’s body. No gun was ever recovered.

The defendant was arrested on March 2, 2016.

On Oct. 26, 2016 in Westchester County Court:

Tejmitra Singh (DOB 12/03/92) of 760 East 237th St., Bronx, NY, was sentenced to eleven years in state prison after having pled guilty to:

  • one count of Assault in the First Degree, a class “B” Violent Felony and

Darren Dawson (DOB 03/04/97) of 4352 Bruner Ave/, Bronx, NY, was sentenced to nine years in state prison after having pled guilty to:

  • one count of Assault in the First Degree, a class “B” Violent Felony.

Garth O’Neil Cole (DOB 04/08/93) of 406 South 3rd Ave., Mount Vernon, NY previously pled guilty to:

  • one count of Criminal Possession of a Weapon in the Second Degree, a class “C” Violent Felony.

He is due to be sentenced next month.

Hunter was remanded into the custody of the New York State Department of Corrections.

Assistant District Attorneys Julia Cornachio and James Bavero of the Superior Court Trial Division are prosecuting the case.
