Jan. 18, 2013 -- Westchester County District Attorney Janet DiFiore announced that Hossam Elfeke (DOB 06/09/73) of 2255 Cruger Avenue, Bronx, New York, following a jury trial was convicted today of:

•    one count of Attempted Disseminating Indecent Material to Minors in the First Degree, a class “E” Felony,

relating to sexually-explicit online communications.

On November 17, 2011 a criminal investigator with the Westchester County District Attorney’s Office in his undercover identity as a 15 year old female was online monitoring the classified advertisement service Craigslist.

The defendant engaged the “15 year old” in a series of email and instant messages.

During the exchange, the undercover investigator stated that “she” was 15 years old.

The online conversations became sexual in nature, with the defendant describing specific sexual acts.

On the afternoon of November 21, 2011 the defendant arrived at a pre-determined meeting place believing he was meeting the 15 year old female he had been corresponding with online.

The defendant was placed under arrest by investigators with the District Attorney’s Office and was arraigned on a Felony Complaint.

Following the verdict, District Attorney Janet DiFiore said, “Every time a predator goes online or into a chat room, he should wonder if the child victim that he is trying to lure into an illegal sexual encounter is really a member of law enforcement. In having members of law enforcement patrolling cyberspace, as in this case, they can intercede and trap a pedophile before their criminal behavior escalates into a physical sexual assault of a real child.”
The defendant was remanded.

The defendant faces a maximum sentence of four years in state prison when sentenced on March 5, 2013.

Assistant District Attorney ToniAnn Gagliardi of the High Technology Crime Bureau is prosecuting the case.
