Scarpino, Jr. announced that Westchester County First Deputy District Attorney James McCarty has been appointed to serve as a judge in the New York State Court of Claims. As the legislative session wrapped up in Albany, his appointment was confirmed by the State Senate Wednesday evening. McCarty was sworn in by Acting Presiding Judge of the Court of Claims Richard E. Sise in Albany and begins in his new role as of Monday.

“It is with great pleasure that I congratulate my friend and colleague Jim McCarty on his appointment to the bench. Jim has been an exemplary prosecutor and mentor to a generation of prosecutors who have served Westchester County. In his leadership roles, he has helped shape the District Attorney’s Office and has been instrumental in making my transition seamless.” Scarpino said. “With Jim on the bench, we know he will continue to distinguish himself in his pursuit of justice. We wish him well.”

McCarty has served 38 years in the Westchester County District Attorney’s Office as a prosecutor and in senior leadership roles including Acting District Attorney. Prior to being named to his current role as First Deputy District Attorney under District Attorney Anthony A. Scarpino, Jr. in 2017, McCarty served as Acting District Attorney for one year after former District Attorney Janet DiFiore vacated her position and became New York’s Chief Judge and before the election of District Attorney Scarpino.

Earlier, McCarty served as the Chief of Trial Operations for 10 years where he oversaw all trials in the superior and local courts in Westchester. Originally appointed as an Assistant District Attorney by District Attorney Carl A. Vergari, he served in the Motions and Appeals Division, the Investigations Division and the Superior Court Trial Division. McCarty was promoted by District Attorney Vergari to Bureau Chief within the Superior Court Trial Division. He continued there during the tenure of District Attorney Jeanine Pirro who promoted him to Deputy Division Chief.

McCarty has tried more than 100 cases, including the successful prosecutions of Carolyn Warmus, the so-called "Fatal Attraction" murder case, and serial killer Patrick Baxter. McCarty is a graduate of the University of Rochester and Albany Law School.
