Sept. 5, 2017 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced today that Bobby Jackson (DOB 08/16/81) of 303 West 122nd Street, New York, NY was sentenced to nineteen years to life by Judge Barry Warhit after pleading guilty on Friday, March 17, 2017  to:

  • one count of Murder in the Second Degree, a class “A” Felony,
  • one count of Criminal Possession of a Weapon in the Second Degree, a class “C” Violent Felony,
  • one count of Reckless Endangerment in the First Degree, a class “D” Felony

in the shooting death of Charles Smith. 

On April 17, 2016 at approximately 5:23 p.m., in the area of East 3rd Street and South 3rd Street in Mount Vernon, the victim was riding his bicycle down East 3rd Street when he was spotted by the defendant.

The defendant started jogging after the victim. Two blocks later, at East 3rd Street and South 1st Avenue, the defendant began shooting at the victim, firing multiple shots, one of which hit the victim in the back.

The bullet entered the lower right side of the back, ripping through the victim’s kidney, colon, liver and a major artery to the lung. The victim then fell off his bicycle and smashed the left side of his head on the concrete pavement. He was dead within minutes.

At the same time the defendant was shooting, there were multiple pedestrians on the street, including a woman pushing a baby stroller, who were in the line of fire.

The defendant was remanded into the custody of the New York State Department of Corrections.

Assistant District Attorney Daniel Flecha of the Superior Court Trial Division prosecuted the case.
