May 26, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Antoine Simmons (DOB 07/18/80) of 1 Lawrence Street, Yonkers, New York, was sentenced today to three and one half to seven years in state prison after having been found guilty at trial on March 9, 2016 of:

  • one count of Vehicular Manslaughter in the Second Degree, a class “D” Felony,
  • one count of Criminally Negligent Homicide, a class “E” Felony,
  • one count of Operating a Vehicle While Ability Impaired By Drugs, a class “E” Felony,
  • one count of Reckless Driving, an Unclassified Misdemeanor under the New York State VTL,
  • one count of Aggravated Unlicensed Operation of a Motor Vehicle in the Third Degree, an Unclassified Misdemeanor under the New York State VTL.

On Oct. 19, 2014 at approximately 3:11 a.m. the defendant was driving a 2001 Lincoln Town car at a high rate of speed in the vicinity of 83 Rumsey Rd. in Yonkers.

He lost control of the vehicle and crashed into a tree splitting the car in half.

His passenger was sitting in the front passenger seat of the vehicle at the time of the crash. She was not wearing a seatbelt and was killed instantly.

The defendant was taken to Jacobi Medical Center in the Bronx with non-life threatening injuries.

Subsequent toxicology tests revealed that the defendant was under the influence of PCP and marijuana at the time of the crash.

The defendant was remanded to the custody of the New York State Department of Corrections.

Senior Assistant District Attorney Heide Mason of the Superior Court Trial Division prosecuted the case.
