May 13, 2014 -- Westchester County District Attorney Janet DiFiore announced that Daniel Forte (DOB 04/14/87) of 817 Terrence Place, Cortlandt Manor, New York was sentenced today to an indeterminate term of 25 years to life in state prison on his February 2014 conviction after a jury trial of:
- one count of Murder in the First Degree, a class “A-1” Felony,
- two counts of Murder in the Second Degree, class “A-2” Felonies,
- two counts of Robbery in the First Degree, class “B” Felonies,
- two counts of Criminal Possession of a Weapon in the Second Degree, class “C” Felonies,
- one count of Robbery in the Second Degree, a class “C” Felony.
An accomplice, Enrique Ansell (DOB 10/07/86) of 126 Valley Street, Sleepy Hollow, New York pled guilty on Jan. 16, 2014 to:
- one count of Robbery in the First Degree, a class “B” Felony,
relating to the death of Kujtim Rushiti and will be sentenced on July 29, 2014.
He faces twenty five years in state prison.
On Jan. 26, 2013 at approximately 8:00 p.m. in the area of Oak and Warren Avenues in Greenburgh, the defendants were engaging in a robbery of a sizable amount of Marijuana.
The defendants insisted on weighing it before the purchase.
At the same time, four individuals arrived on the scene with the Marijuana.
A number of participants then walked toward the front stoop of 172 Warren Ave ostensibly to go into the location to weigh the drugs.
At this point Forte pulls out a handgun and strikes the seller.
The seller calls out to his friends who exit their vehicle and rush towards their friend who was down on the ground.
As they went to their friend’s aid, Forte fires directly at the victim, striking him in the neck.
His friends dragged him back to their vehicle and called police.
The victim was taken to Westchester Medical Center and subsequently died.
Greenburgh police and the District Attorneys office initiated an extensive investigation, processing the crime scene, interviewing witnesses, forensically analyzing cell phone movements, thereby quickly developing information on the defendants and their movements after the shooting.
Both defendants were subsequently arrested by Greenburgh detectives.
Assistant District Attorney Christine O’Connor, Chief of the Narcotics and Firearms Bureau and Assistant District Attorney Jonathan Strongin of the Narcotics and Firearms Bureau are prosecuting the case.
