March 11, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Franklin Figueroa (DOB 11/12/88) of 620 East Main St., Jefferson Valley, NY has been indicted and charged with:

  • three counts of Unlawful Surveillance in the Second Degree, class "E" Felonies,
  • two counts of Endangering the Welfare of A Child, class "A" Misdemeanors.

On March 2, 2015, at approximately 2:50 p.m., the defendant was at the Metro North Train Station located in Golden's Bridge. A shuttle bus transporting students from the J.F.K Catholic High School arrived. They disembarked and proceeded to climb a stairwell to the train platform in their school uniforms.

The defendant, sitting in that same stairwell used a concealed video camera and recorded images from underneath the female student's skirts.

A student realizing what was happening quickly photographed the defendant and his camera with her cellphone and wrote down the license plate number of the vehicle that he subsequently retreated to.

The MTA Police were immediately contacted and the defendant was later arrested. Several recording devices were seized from the defendant and searched pursuant to a search warrant which revealed an earlier offense involving a student at the Golden's Bridge train station from the spring of 2014.

At the time of the incident, the defendant was working for Laz Parking in Collections and Enforcement which is contracted to conduct parking enforcement at the train station. Figueroa continues to be employed by them.

His next court date is May 10, 2016.

Figueroa was released on his own recognizance.

The defendant faces a maximum sentence of four years in state prison.

Assistant District Attorney Michelle Lopez of the Sex Crimes Bureau is prosecuting the case.
