March 9, 2016 -- Acting Westchester County District Attorney James A. McCarty announced that Antoine Simmons (DOB 07/18/80) of 1 Lawrence St., Yonkers, NY, was found guilty today of:

  • one count of Vehicular Manslaughter in the Second Degree, a class "D" Felony,
  • one count of Criminally Negligent Homicide, a class "E" Felony,
  • one count of Operating a Vehicle While Ability Impaired By Drugs, a class "E" Felony,
  • one count of Reckless Driving, an Unclassified Misdemeanor under the New York State VTL,
  • one count of Aggravated Unlicensed Operation of a Motor Vehicle in the Third Degree, an Unclassified Misdemeanor under the New York State VTL.

On Oct. 19, 2014 at approximately 3:11 a.m. the defendant was driving a 2001 Lincoln Town car at a high rate of speed in the vicinity of 83 Rumsey Rd. in Yonkers.

He lost control of the vehicle and crashed into a tree splitting the car in half.

His passenger was sitting in the front passenger seat of the vehicle at the time of the crash. She was not wearing a seat belt and was killed instantly.

The defendant was taken to Jacobi Medical Center in the Bronx with non-life threatening injuries.

Subsequent toxicology tests revealed that the defendant was under the influence of PCP and marijuana at the time of the crash.

The defendant's remand continues.

He is due to be sentenced on April 20, 2016.

The defendant faces a maximum of seven years in state prison.

Assistant District Attorney Heide Mason of the Superior Court Trial Division is prosecuting the case.
