March 2, 2016 -- Acting Westchester County District Attorney James A. McCarty announced today that four people have been charged in the shooting death of Michael Nolan:

Nashaun Hunter (DOB 07/29/98) of 4375 Bruner Avenue, Bronx, NY, New York, was charged with:

  • one count of Murder in the Second Degree, a class "A" Felony,
  • two counts of Criminal Possession of a Weapon in the Second Degree, class "C" Violent Felonies,

Garth O'Neil Cole (DOB 04/08/93) of 406 South 3rd Ave., Mount Vernon, NY was charged with:

  • one count of Assault in the First Degree, a class "B" Violent Felony,
  • two counts of Criminal Possession of a Weapon in the Second Degree, class "C" Violent Felonies,

Darren Dawson (DOB 03/04/97) of 4352 Bruner Avenue, Bronx, New York was charged with:

  • one count of Assault in the First Degree, a class "B" Violent Felony,
  • two counts of Criminal Possession of a Weapon in the Second Degree, class "C" Violent Felonies,

Tejmitra Singh (DOB 12/03/92) of 760 East 237th Street, Bronx, New York was charged with:

  • one count of Assault in the First Degree, a class "B" Violent Felony,
  • two counts of Criminal Possession of a Weapon in the Second Degree, class "C" Violent Felonies.

"The allegations in the indictment are frightening. It's alleged that Nashaun Hunter aided and abetted by Garth O'Neil Cole, Darren Dawson and Tejmitra Singh piled into a car and drove to a fast food restaurant at which point the car they were in slowed so that Hunter could fire six shots and kill Michael Nolan, an innocent young man with a promising future" said Acting District Attorney McCarty.

On Sept. 18, 2015 at approximately 12:38 a.m. in the area of 826 Central Park Ave., Yonkers NY the victim was standing outside of his black Mercedes loaner car in the parking lot of the Burger King Restaurant when a white Toyota Camry slowly rolled up alongside.

Inside the vehicle were the four defendants. Suddenly, six shots rang out from the back driver's side window of the Camry one of which struck Michael Nolan in the head.

He was brought to Jacobi Medical Center in the Bronx where he remained in a coma until he was declared dead on Oct. 9, 2015. An extensive investigation by the Yonkers Police Department and the Westchester County District Attorney's office revealed that the shooting was in retaliation for the beating of an individual known to the suspects and related to events that took place during a drag race two nights before the shooting.

.25 caliber shell casings were found at the scene. A .25 caliber bullet was recovered from the victim's body.

The defendants were arrested on March 2, 2016.

They have been and were remanded.

Their next court date is March 3, 2016.

The charge of Murder in the Second Degree brings with it the possibility of an indeterminate term of imprisonment, a maximum of which is 25 years to life in state prison.

The charge of Assault in the First Degree brings with it a possibility of a maximum sentence of 25 years in state prison.

The charge of Criminal Possession of a Weapon in the Second Degree brings with it a possibility of a maximum sentence of 15 years in state prison.

Assistant District Attorneys Julia Cornachio and James Bavero of the Superior Court Trial Division are prosecuting the case.
